Transport damage
For private consumers:
If goods are delivered with obvious transport damage, please complain about such defects to the deliverer immediately if possible and contact us without delay. Failure to complain or contact us has no consequences for your legal claims and their enforcement, in particular your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.
For entrepreneurs:
The risk of accidental loss and accidental deterioration passes to you as soon as we have delivered the goods to the forwarder, carrier, or other person or institution designated to carry out the shipment. Among merchants, the duty to examine and give notice of defects regulated in § 377 HGB applies. If you fail to give the notice regulated therein, the goods shall be deemed approved, unless it is a defect that was not recognizable during the examination. This does not apply if we have fraudulently concealed a defect.
Invoicing
You will receive the corresponding invoice together with the goods upon delivery.
Payment
Payment is made
For private customers by paying for the goods as per the corresponding entry in the shopping cart.
For commercial customers generally by direct debit after delivery of the goods.
Retention of title
The delivered goods remain our property until full payment. For entrepreneurs, the following also applies: We retain title to the goods until all claims from an ongoing business relationship have been settled in full. You may resell the reserved goods in the ordinary course of business; you hereby assign to us in advance all claims arising from this resale - irrespective of whether the reserved goods are combined or mixed with a new item - in the amount of the invoice amount, and we accept this assignment. You remain authorized to collect the claims, but we may also collect claims ourselves if you do not meet your payment obligations.
Warranty and guarantees
Unless expressly agreed otherwise below, the statutory liability for defects applies.
For consumers, the limitation period for claims for defects in used goods is one year from the delivery of the goods. For entrepreneurs, the limitation period for claims for defects is one year from the transfer of risk; the statutory limitation periods for the right of recourse under § 478 BGB remain unaffected.
Towards entrepreneurs, only our own statements and the product descriptions of the manufacturer that were included in the contract are considered an agreement on the quality of the goods; we assume no liability for public statements by the manufacturer or other advertising statements.
If the delivered item is defective, we shall, at our discretion, initially provide a warranty to entrepreneurs by remedying the defect (rectification) or by delivering a defect-free item (replacement delivery). The foregoing limitations and reductions in deadlines do not apply to claims for damages caused by us, our legal representatives, or vicarious agents
+ in case of injury to life, body or health
+ in case of intentional or grossly negligent breach of duty as well as malice
+ in case of breach of essential contractual obligations, the fulfillment of which enables the proper execution
+ of the contract in the first place and on whose compliance the contractual partner regularly + may rely (cardinal obligations)
+ within the scope of a guarantee promise, if agreed
+ insofar as the scope of the Product Liability Act is applicable.
Information on any additional guarantees that may apply and their exact conditions can be found with the respective product and on special information pages in the online shop.
Liability
For claims for damages caused by us, our legal representatives, or vicarious agents, we are always liable without limitation
in case of injury to life, body or health,
in case of intentional or grossly negligent breach of duty,
in case of guarantee promises, if agreed, or
insofar as the scope of the Product Liability Act is applicable.
In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract in the first place and on whose compliance the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, our legal representatives or vicarious agents, liability for damages is limited to the foreseeable damage typical for the contract at the time of its conclusion. Otherwise, claims for damages are excluded.
Dispute resolution
The European Commission provides a platform for online dispute resolution (OS), which you can find here https://ec.europa.eu/consumers/odr/. Consumers have the option of using this platform for the resolution of their disputes. To resolve disputes arising from a contractual relationship with a consumer or about whether such a contractual relationship exists at all, we are obliged to participate in dispute resolution proceedings before a consumer arbitration board. The General Consumer Arbitration Board of the Zentrum für Schlichtung e.V., Straßburger Straße 8, 77694 Kehl am Rhein, www.verbraucher-schlichter.de, is responsible. We will participate in a dispute resolution procedure before this body.

If you are a merchant in the sense of the German Commercial Code, a legal entity under public law or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from contractual relationships between us and you is our registered office.
